Delivery of waste from ships - obligations of the ship

All ships with a gross tonnage greater than 300 has to make an advance waste notification before arrival to a Swedish port. Ships are obligated to deliver all waste types for which disposal at sea is prohibited, to a port reception facility. The ship may continue to the next port of call without delivering the waste, if the information provided in accordance with Annexes 2 and 3 of the Directive (EU 2019/883) on port reception facilities for the delivery of waste from ships, shows that there is sufficient dedicated storage capacity for all waste that has been accumulated and will be accumulated during the intended voyage of the ship until the next port of call.

Ships exempted from mandatory waste delivery

The following ships are exempted from mandatory waste delivery given that they have frequent and regular port calls to a specific port where they have an arrangement for waste delivery and have enough waste storage to keep all existing waste in storage until the next port call;

  1. Ships in national archipelago traffic and water taxis which are used for one or more of the following port services;
  2. bunkering
  3. cargo handling
  4. mooring
  5. passenger service
  6. collection of waste and cargo residues
  7. pilotage
  8. towing

  9. Ships engaged in scheduled traffic which have been granted exemption from mandatory waste delivery by The Swedish Transport Agency.

Advance waste notification

All ships with a gross tonnage above 300 are obligated to make an advance waste notification via The Swedish Maritime Singel Window (MSW Reportal) hosted by The Swedish Maritime Administration, before making a port call.

The following ships are exempted from advance waste notification.

  1. Fishingvessels, traditional ships, and recreational crafts shorter than 45 meters.
  2. Warships and naval auxiliary ships.
  3. Other ships, owned by a memberstate of the EU, that is used for non-commercial purposes.
  4. Ships engaged in scheduled traffic which have been granted exemption from advance waste notification by The Swedish Transport Agency.

Ships shall forward their advance waste notification at least 24 hours in advance of arrival or upon departure of the previous port if the voyage is less than 24 hours. If the ships next port call is determined less than 24 hours in advance, the advance waste notification should be forwarded as soon as the port of call is known.

The advance waste notification should be kept onboard the ship at least until the next port of call, and shall be provided upon inspection.

Waste delivery

Ships are obligated to deliver all waste types for which disposal at sea is prohibited, to a port reception facility before departure from a Swedish port.

Sufficient waste storage capacity

Ships with a gross tonnage under 300 may proceed to the next port of call without delivering waste if there is enough storage capacity for all waste that has been accumulated and will be accumulated during the intended voyage of the ship.

Dedicated waste storage capacity

Ships with a gross tonnage of 300 and above may proceed to the next port of call without delivering waste if there is sufficient dedicated storage capacity for all waste that has been accumulated and will be accumulated during the intended voyage of the ship, calculated from the information that has been given in the advance waste notification as well as waste delivery receipts from the ships previous port of call.  

Dedicated waste storage capacity shall be calculated in accordance with the commission implementing regulation (EU) 2022/89.

The commission implementing regulation (EU) 2022/89 includes thresholds for waste storage. If the amount of waste in storage surpasses the corresponding threshold, the waste shall be delivered to a port reception facility in the present port of call.

The Swedish Transport Agency can order the ship to deliver all waste to a swedish port, regardless of the amount of waste stored, if the next port of call is unknown.

Sanctions imposed for failing to forward advance waste notificationd or failing to deliver waste

Failing to forward an advance waste notification can lead to a penalty fee of 
15 000 SEK.

Failing to deliver waste can lead lead to a penalty fee of;

1.     2,500 SEK if the ship has a gross tonnage of 50 or less.

2.     10,000 SEK if the ship has a gross tonnage greater than 50, but not greater than 500.

3.     15,000 SEK if the ship has a gross tonnage greater than 500, but not greater than  3,000.

4.     20,000 SEK if the ship has a gross tonnage greater than 3,000, but not greater than   15,000.

5.     35,000 SEK if the ship has a gross tonnage greater than 15,000, but not greater than 50,000.

6.     50,000 SEK if the ship has a gross tonnage greater than 50,000.
